Terms of Service

Welcome to Customer Portal Solutions! By using our products, software, services, and websites (collectively, the “Services”), you agree to these Terms of Service (“Terms”), which form a binding agreement between you (“User”) and Customer Portal Management Services, LLC (“Customer Portal,” “we,” or “us”). “User” includes you as an individual and, if applicable, the company or entity you represent. You confirm that you are at least 18 years old and authorized to enter this agreement. These Terms apply to our website at www.customerportal.solutions, my.customerportal.solutions, help.customerportal.solutions, and any subdomains or related URLs (the “Site”), as well as the Customer Portal Platform.

This is an electronic agreement. By accessing the Site or subscribing to our Services, you consent to receive these Terms and related notices electronically. Please read these Terms carefully, as they govern your use of the Services.

1. Using Our Services

1.1 Eligibility. You must be at least 18 years old to use our Services. If you’re using Services on behalf of a company, you confirm you have authority to bind that entity. Users under 13 are prohibited, and those 13-17 require parental consent and supervision.

1.2 Account Security. You’re responsible for keeping your account credentials (username, password) confidential and for all activities under your account. Notify us immediately at info@customerportal.solutions if you suspect unauthorized use. We’re not liable for losses from unauthorized access, but you may be.

1.3 Service Changes. We may modify, suspend, or discontinue any part of our Services at any time without notice. We’ll notify you of significant changes via email or the Site. Continued use after changes means you accept them.

2. Your Responsibilities

2.1 Proper Use. Use our Services for lawful purposes only. You agree not to:

  • Post or share illegal, harmful, or infringing content (e.g., hate speech, malware).

  • Spam, phish, or engage in unauthorized marketing.

  • Interfere with our Services’ operation or security.

  • Violate others’ rights, including privacy or intellectual property.

2.2 Prohibited Activities. You may not use our Services for illegal or high-risk activities, such as fraud, unregulated financial schemes, or misinformation. We may update this list and suspend accounts violating these rules.

2.3 Content Ownership. You retain ownership of content you upload but grant us a worldwide, royalty-free license to use, store, and display it as needed to provide our Services. We may remove content violating these Terms.

3. Privacy and Data Protection

We collect data like your name, email, payment details, and usage information to deliver and improve our Services. We use cookies and similar tools with your consent, and we may employ AI for analytics or personalization (details in our Privacy Policy). You have rights to access, correct, or delete your data under laws like GDPR and CCPA. We may transfer data internationally with safeguards. By using our Services, you agree to our Privacy Policy and data practices.

4. Accessibility

5. Payments and Subscriptions

5.1 Billing. Premium accounts are billed monthly or annually to your provided payment method. Fees are non-refundable, but you may cancel anytime via “Account Settings > Manage Subscription.” Access continues until the paid period ends.

5.2 Taxes. You’re responsible for applicable taxes, except U.S. income taxes on Customer Portal.

 

6. Intellectual Property

6.1 Our Rights. The Site, Services, and content (e.g., text, logos, software) are owned by Customer Portal or our licensors, protected by copyright, trademark, and other laws. You may not copy, modify, or distribute them without permission.

6.2 DMCA Policy. If you believe your work was infringed, contact our Copyright Agent at dmca@customerportal.solutions with details. We may terminate accounts of repeat infringers.

 

7. Disclaimers and Liability

7.1 As-Is Service. Our Services are provided “as is” without warranties, express or implied, including for merchantability or fitness for a particular purpose. We don’t guarantee uninterrupted or error-free operation.

7.2 Liability Limits. Customer Portal isn’t liable for indirect, incidental, or consequential damages (e.g., lost profits) arising from your use of our Services, to the fullest extent allowed by law. Some jurisdictions may not allow these limits.

 

8. Dispute Resolution

8.1 Informal Resolution. Contact us at info@customerportal.solutions to resolve issues within 60 days before escalating.

8.2 Mediation. Unresolved disputes go to mediation via JAMS, with shared costs.

8.3 Arbitration. If mediation fails, binding arbitration under AAA Consumer Rules applies, conducted remotely or in Delaware. Opt out within 30 days by emailing us. You waive jury trial rights unless opted out.

 

9. Termination

We may suspend or terminate your account for violating these Terms, with notice where feasible. Upon termination, you lose access to your data, but we’ll retain it for 12 months for paid accounts (3 months for free trials) per Section 10. Surviving provisions (e.g., liability, IP) remain in effect.

 

10. Data Retention

Free Trials: Data from inactive free trials is deleted after 3 months.

Paid Accounts: Data from canceled or expired paid accounts is retained for 12 months, then deleted unless reactivated.

 

11. General Terms

11.1 Governing Law. Delaware law governs these Terms, excluding conflict of laws. Disputes not subject to arbitration are handled in Delaware courts.

11.2 Changes. We may update these Terms, effective upon posting. Continued use means acceptance. Check for updates at https://customerportal.solutions/terms.

11.3 Entire Agreement. These Terms, with our Privacy Policy, are the full agreement, superseding prior agreements. If a provision is unenforceable, others remain valid.
